Minister response to HMRC issues (Wales)/Ymateb y gweinidog i faterion CThEF (Cymru)

As you should be aware HMRC recently confirmed that childminders under Making Tax Digital (MTD) must use standard rules for self-employed people for expenses, instead of the existing agreement that sets out how childminders can claim expenses (known as BIM52751).

This means anything unique to the historic agreement – including the current blanket 10% wear-and-tear allowance – will not apply for childminders under MTD. They will instead need to claim only for actual repairs and purchases made.

We know this announcement has caused significant concern across the childminding community and we are urging HMRC and Government to understand the unique nature of childminding and retain the wear and tear allowance for all childminders.

As part of this work Coram PACEY Cymru wrote to Dawn Bowden, Minister for Children and Social Care around the unexpected change to childminders’ tax-free ‘wear and tear’ allowance. In the letter we stated the significant adverse impact this could have upon the sustainability of childminding businesses in Wales. If this were to happen, this could reduce much-needed capacity for childcare at a time when we are experiencing acute shortages of childcare and are working collectively to improve childminder retention and recruitment.

In the response the Minister stated that Welsh Government officials have liaised with HMRC colleagues to share the concerns we raised. However (as we are aware) tax policy in relation to Income Tax is a reserved matter with Welsh Government not having decision making powers.

The Minister did recognise the unique offer childminders provide in working from their homes supporting children and their families across Wales. She also acknowledged the long-term trend associated with childminders leaving the profession, and stated that Welsh Government are committed to continue efforts to encourage and support childminders into the profession and support the retention of existing childminders.

Though the response is disappointing it is not unexpected given the powers that Welsh Government have. Coram PACEY Cymru will continue to liaise and lobby with colleagues in Coram PACEY and across Scotland and Northern Ireland to strengthen our voice in lobbying on this key issue.
